Full judgment

1. The Regulator provided a decision on the Appellant’s application for a review on 13 April 2024. The appeal was received on 29 May 2024. The appeal is out of time.

2. On 16 August 2024 the Appellant was ordered to send to the Tribunal: a. A request for an extension of time and b. A written explanation of why the notice of appeal was not provided in time.

3. The Appellant was warned in the order of 16 August 2024 that failure to comply with the above direction would automatically lead to the striking out of the proceedings under rule 8(1) of the Rules.

4. The Appellant has not complied with the above directions.

5. The Appellant failed to comply with the Case Management Directions dated 16 August 2024 and there are grounds to strike out the appeal because the Appellant failed to comply with a direction that stated that failure to comply with the direction would automatically lead to the striking out of the proceedings.

6. The Appellant may apply for the proceedings to be reinstated under Rules 8(5) and (6) of the Rules. The application must be in writing and be received by the Tribunal within 28 days after the date on which this Decision is issued.
